What we do: 

At PhytoBalance, we produce a range of nutrient-rich microgreens, juices and health food  supplements which we sell online directly to consumers in the UK.

We have made every effort to display as accurately as possible the colours and images of our  products as they appear in real-life. We cannot guarantee that your computer monitor’s display  of any colour will be accurate.

All descriptions of products are subject to change at any time without notice, at our sole  discretion.  

We reserve the right but are not obligated, to limit the sales of our products or subscriptions to  any person or geographic region. We may exercise this right on a case-by-case basis. We reserve  the right to limit the quantities of any products or services that we offer. We reserve the right  to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 

Our Pricing:  

The total price for each of our products is clearly stated on our Site and inclusive of VAT where  applicable. Except for typographical errors for which we will not be liable, the price displayed on our website for a product, is the price you agree to pay us.

Prices for our products are subject to change at any time without notice, at our sole discretion.  We shall not be liable to you or to any third-party for any price change. If you subsequently amend your order to add products, the prices charged will be those applicable to the new price of the product/s at the time that your amended order is confirmed. Please note that as promotions are offered for a limited period of time, subsequent amendments to your order may mean that certain promotions are no longer being offered.

Your Orders:  

Completing Your Order:  

You agree to purchase products from PhytoBalance subject to these Terms and Conditions and our Privacy Policy will apply to all transactions using phytobalance.co.uk. We accept a variety of different payment methods. The methods we can accept to process your payment are listed on our Site on the date of which your order is placed.

You agree to provide current, complete and accurate purchase and account information for all  purchases made through our Site. You agree to promptly update your account and other  information, including your email address and credit card numbers and expiration dates  so that we can complete your transactions and contact you as needed.  

Fulfilling Your Order: 

Once you have placed an order for products through our Site, we will send you written  confirmation of your order by email.  

Once you have placed your order, if you change your mind and wish to amend it, please contact us immediately by telephoning us on 01908 751 495 or 07518 046 472 or via email at info@phytobalance.co.uk and we will do our best to amend your order prior to it being dispatched. See also Cancelling Your Orders below.

Delivering Your Order:  

Your order may include a charge for delivery. If your delivery is subject to a delivery charge, the cost to you will be calculated and displayed before you confirm your order. Any delivery charge added to your order will be dependent upon the total weight of your packaged order.

Deliveries are made via the Royal Mail and in MOST cases will be delivered  by the next working day following dispatch but it is NOT a guaranteed next-day service.  

We currently ship to the UK ONLY. We will not add extra surcharges for deliveries in Northern  Ireland, Channel Islands or the Highlands of Scotland.

All orders are subject to availability. If you place an order for a product that is out of  stock at the time of ordering, we will contact you to let you know. We will fulfil your order  automatically when the item becomes available unless you contact us and instruct us  not to do so. In the event that a product is out of stock, you may cancel your order by  clicking on the following link: Cancellation Form.

Salad Deliveries: 
We have developed a highly successful planting schedule to ensure that all of our  microgreen salads grow to achieve their optimum nutritional value. We harvest our  salads twice weekly, on Mondays and Thursdays.  
The deadline for same day delivery is 9:00 am on these harvest days. Orders received  before 9:00 am on one of our harvesting days will be sent out for delivery on the same  day. Orders placed after 9:00 am on a harvest day will be shipped on the next scheduled harvest day. So, depending on when during the week you place your salad order, you may have to wait a day or so to receive it.
It is important that your salad is refrigerated immediately when you receive it so please  make sure that you are available to take delivery of your order when it arrives OR that  you make appropriate arrangements for someone to take delivery and refrigerate your  order on receipt of delivery in the event that you are not able to do so. 
In the event of a harvest day falling on a UK Bank Holiday, orders will be shipped on the  next working day following the Bank Holiday. 
All Other Deliveries 
We try our best to fulfil orders as quickly as we can and wherever possible will arrange  for your order to be shipped to you on the same day that you place an order. 
Orders received by 12:00 midday Monday-Friday (excepting Bank Holidays) will be sent  by Royal Mail on the same day. 
Orders received after this deadline will be shipped to you on the next working day. 

Loss or Damage in Transit of Your Order: 

It is our responsibility to ensure that your order is delivered successfully to you. In the event  that your delivery does not arrive to you or the nominated person that you have asked us to  deliver your order to, or it arrives damaged, please contact us immediately so that we can  investigate.  

If it is found that your order is lost or has been damaged in transit, we will arrange for a  replacement order to be sent to you. Alternatively, if you prefer, we will fully reimburse you for  the cost of your order. 

Cancelling your Order: 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit  or cancel quantities purchased per person, per household or per order. These restrictions may  include orders placed by or under the same customer account, the same credit card, and/or  orders that use the same billing and/or shipping address. In the event that we make a change  to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing  address/phone number provided at the time the order was made. You will be entitled to a full  refund of your order, including all delivery charges. We reserve the right to limit or prohibit  orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

Your Rights to Cancel your Order: 

Cancelling Orders for Salads 
Due to the short shelf-life of our fresh salads, it is not possible for you to cancel your order once it has been shipped. Salad orders cannot be returned under our Returns Policy.  
Cancelling Orders for All Other Products (Excl Salads)
You are entitled to cancel your order within 14 days without giving any reason for your  decision.  
This cancellation period starts the day after the day on which the order is delivered into  your physical possession or the person that you have asked us to deliver the products  to. If your order is for multiple products and for some reason, it has been necessary to  deliver those products on different days, the cancellation period of 14 days will start the  day after the last of the product is delivered into your physical possession or the person  that you have asked us to deliver the products to. If no products have been supplied, If  no goods were supplied, we will reimburse you within 14 days on the day after the day  we are informed of your decision to cancel. 
Cancellation is only effective if you send communication to us before the end of the cancellation period. 
To cancel your order, you can click on the following link to complete our online Cancellation Form.
There is no requirement for you to use our online Cancellation Form. You can use any  other clear statement to inform us of your decision to cancel (for example by email or  by post, including the details as laid out in our Cancellation Form). Using our online Cancellation Form will enable us, without delay, to acknowledge receipt of your  cancellation. (In the event of a dispute, the burden to prove that you did cancel within  the cancellation period falls on you. Therefore, you are well advised to ensure that you  have some durable proof of your cancellation, as we could ask for this if there was a  dispute regarding whether or when you had informed us of your decision to cancel). 
We will reimburse you what you have paid us for the product you wish to cancel,  including any original delivery costs. We will reimburse you using the same payment  method that you used originally, or by an alternative payment method, subject to  agreement between both parties. We have a right to deduct an amount from your  reimbursement if you have diminished the value of the product/s by handling them  beyond what is necessary.

Subscriptions: 

Salad Subscriptions 

When you purchase a subscription for a salad, you'll receive repeat deliveries of your order.  Deliveries are based on the subscription delivery frequency that you select. At present, you  may choose to subscribe for a repeat delivery every 7, 14 or 30 days. 

Your subscription will take effect immediately once you purchase your subscription.  

Because we follow a successful growing schedule to ensure our microgreen salads are grown  to achieve their peak nutritional value, we harvest our microgreen salads twice-weekly on  Mondays and Thursdays. Orders received by 9:00 am on one of our harvesting days will be  sent out for delivery on the same day. Orders received after 9:00 am on a harvest day will be  shipped on the next scheduled harvest day. Depending on when during the week you purchase your subscription, you may have to wait a day or so to receive your first delivery. The delivery  date of your first subscription will be counted as the first date of your subscription period. 

Your payment details will be stored securely and you'll be charged for each of your future  deliveries on the day of dispatch. 

Subscriptions will auto-renew at the end of their duration. If you don’t want to renew a  subscription you can cancel it at any time in advance of your next scheduled delivery but  before 9:00 am on the day your order is scheduled to be harvested. Subscriptions cancelled  after this time will take effect for the next successive subscription delivery date. 

If you want to cancel or change your subscription, you can do it at any time. Your order  confirmation email contains a link to your order. You can manage your subscription from  there. You can also cancel your subscription by writing to us or emailing us (including the details as laid out in our Cancellation Form) or by clicking here on our online Cancellation Form.

Our Returns Policy: 

Salad Order Returns 
Due to the short shelf-life of our fresh salads, it is not possible for you to cancel your  order once it has been shipped. Salad Orders cannot be returned under our Returns Policy. 
All Other Product Returns (exc Salads) 
For food safety and hygiene reasons, ONLY sealed products that have not been opened  can be returned. If a product is opened and unsealed, you will not be entitled to cancel  your order of it and return it to us. 
You must not delay return of the products in your order that you wish to cancel and  should send them back within 14 days of when you informed us of your decision to  cancel. 
If you wish to return your products to us, you must notify us in writing by post or by  email including the details laid out in our Cancellation Form or you may do so by  clicking on the following link to complete our online Cancellation Form. Enclose a copy of your completed cancellation notice together with the product/s being returned.  
It is your responsibility to arrange for and pay the costs of returning your order to us. 
If you return products to us, we will reimburse you within 14 days of the day we receive  the products back or, if earlier, 14 days from the day we receive proof from you that you  have sent the products back to us. If no goods were supplied, we will reimburse you  within 14 days on the day after the day we are informed of your decision to cancel. 
We may withhold reimbursement until we have received the product/s back or you have  supplied evidence of having sent back the product/s, whichever is the earliest. 
We have a right to deduct an amount from your reimbursement if you have diminished  the value of the product/s by handling them beyond what is necessary. 
We will reimburse you using the same payment method that you used originally, or by  an alternative payment method, subject to agreement between both parties.

Recalling Your Order: 

In the unlikely event that the need arises to recall a product that you have ordered, we shall  undertake all reasonable endeavours to contact you to arrange for the product to be destroyed  or returned: A Recall Notice will be prominently displayed on the Home Page of our Site; we shall  send an email to the email address that you have provided in your Personal Information alerting  you of the need to recall the product, and we shall try to contact you by telephone using the  telephone number (if you have provided one) in your Personal Information that we retain.  

You agree to promptly update your account and other information, including your email address  so that we can contact you as needed. 

We will notify all relevant competent authorities without delay about the product being recalled. 

Complaint Handling: 

We hope that you are delighted with all aspects of your order and are really sorry if you need to  make a complaint. Should you be dissatisfied in any way with any aspect of your order, delivery,  or a specific product, we want to know!

All complaints are recorded and reviewed on a regular basis to enable us to identify how we can  improve any aspects of the products that we sell and the services we provide to our customers.  We want to get right anything that we get wrong! 

Alternative Dispute Resolution: 

If you’ve been in touch and are unhappy with our resolution to your complaint, please let us  know. If you remain unhappy with any final resolution, we are required to let you know about  Alternative Dispute Resolution (ADR). More information on ADR can be found on the Chartered Trading Standards Institute (CTSI). PhytoBalance does not subscribe to any ADR provider, however, one such provider  is:

If at our request, you send certain specific submissions (for example contest entries) or without  a request from us you send creative ideas, suggestions, proposals, plans, or other materials,  whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that  we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise  use in any medium any comments that you forward to us. We are and shall be under no  obligation (1) to maintain any comments in confidence; (2) to pay compensation for any  comments; or (3) to respond to any comments.
